Newark Mayor Ras J. Baraka filed a lawsuit Tuesday morning against Alina Habba, interim U.S. Attorney for New Jersey, and Ricky Patel, special agent in charge at Homeland Security Investigations, charging they subjected him to false arrest and malicious prosecution on May 9 outside the Newark immigrant detention center and later charged him with federal trespassing.

The misdemeanor trespassing charge was eventually dropped by Habba.

“The charges were so unsubstantiated they were dismissed 13 days later,” said Attorney Nancy Erika Smith outside the U.S. District Court for the District of New Jersey on Tuesday morning.

Baraka is also suing Habba for defamation, as she made statements regarding his arrest on her personal X account and on Fox News. She wrote on her X account on May 9 tha
