ANDERSON COUNTY, S.C. (FOX Carolina) - A judge denied an appeal that attempted to prove that a developer would be putting new homes over unmarked graves of formerly enslaved people.

The land is about five miles from Pendleton, which is the site of a former plantation.

In August 2024, a judge stopped the plans for the housing development after the Anderson County Planning Commission approved the plans.

Then in November 2024, a judge remanded the matter back to the Planning Commission, but suggested the commission require adequate testing to determine if there are unmarked graves.

The plans were approved a second time by the Planning Commission in January 2025.
