ST. LOUIS, Mo. (First Alert 4) - The legal battle connected to a toddler’s death at a daycare has moved to the Missouri Supreme Court.

On Tuesday, the Judge who was slated to oversee the wrongful death lawsuit of 3-year-old Conrad Ashcraft recused himself as the case moved to the Missouri Supreme Court.

The case, brought by Conrad’s mother, Tara Williams, accuses Poppy’s Playhouse in Park Hills, Missouri, of causing the death of her son on May 16 .

The suit has already seen shifts in legal proceedings, with the case being moved from the St. Francois County Prosecutor’s office to the Jefferson County Prosecuting Attorney’s office on May 19.
