A Guilford County judge is weighing whether or not to throw out the conviction of a man found guilty in a 1998 Greensboro murder.

Over the course of two days late last month, Superior Court Judge Susan Bray heard witnesses and arguments from attorneys in the bid to exonerate 47-year-old Benjamin Cole.

Cole was found guilty in the 1998 killing of Calvin Jenkins during a robbery.

The prosecution conceded there is no physical evidence linking Cole to the murder. Cole maintained he could not be the killer because he was at a recording studio in Dayton, Ohio, at the time.

Prosecutors relied on the testimony of two women who were in the apartment where Jenkins was killed in order to convict Cole. While two men were involved in the robbery, no other suspects have been charged in the case.
