On request of the US Attorney's office, a federal magistrate judge in Boston yesterday dismissed the case against a Lynn man who was arrested by federal agents who claimed they were after the driver of the van he was in, but he allegedly got in their way and the driver escaped.

The man had been charged with assault on a federal officer after Homeland Security, FBI and DEA agents stopped a work van outside a Lynn elementary school Wednesday morning and, according to the FBI, the man "abruptly opened the passenger side door into the body of the DEA agent" and then began resisting and scratched the agents who tried to subdue him as the alleged target of their arrest attempt ran away.

The incident was captured on video.
