OMAHA, Neb. —
The Nebraska Supreme Court reversed the Court of Appeals and put Jeremiah Thornton's case back to district court.
He is charged with first-degree sexual assault.
Back in December 2023, prosecutors say Thornton, then 15, texted a female student to meet in an area of the school, then forced her down and forced her clothing off.
Another 15-year-old student stood as lookout to make sure no one could come in, according to prosecutors.
The victim immediately reported the incident to school officials.
Prosecutors allege that Thornton admitted that the girl was saying "No."
In December 2024, Thornton's lawyers filed an appeal to move the case to juvenile court after their motion to transfer was denied in Douglas County District Court.
