The Washoe County District Attorney's Office has determined that Nevada State Police Trooper Marcus McIntosh was justified in firing his gun at a suspect who shot at him after a chase.
Neither of the troopers on scene or suspect Darnelle Boykins was injured.
According to the DA's report released Friday, McIntosh contacted Boykins, 34, at a gas station near Veterans Parkway around 10 p.m. June 10, 2023, after a 911 call came in about an erratic driver.
McIntosh reported Boykins had slurred speech, red watery eyes and smelled of alcohol, according to the DA's report released Friday.
When McIntosh asked Boykins how much he had to drink, Boykins sped off, driving north in the southbound lane on South Virginia Steet.
