Update (6/6/2025, 3:40 p.m.):
Nicholas Powell, who was arrested in connection to a January murder in Incline Village, appeared in court today for a status hearing.
During the status hearing, Powell's representation asked the court for the case to be dismissed without prejudice - stating the case should be thrown out because Powell's due process rights were allegedly violated.
Powell's team is arguing that when he was ruled incompetent to stand trial on May 6 of this year, he should've been transported to a treatment facility quickly. They cite a Nevada Supreme Court ruling that states that a delay in transporting an individual for the "appropriate restoration to competency" is a violation of due process.
