CHARLESTON, W.Va. (WCHS) — The West Virginia Supreme Court has overturned the murder convictions of a man who killed four members of his family in Elkview in 2020.
Gavin Smith, who is 21 now and 16 when the crimes occurred, is currently serving three lifetime sentences for first-degree murder, 40 years for second-degree murder and 10 years for use or presentment of a firearm during the commission of a felony. He will now be given a new trial based on the high court's ruling that came down late Monday.
Smith was found guilty during a trial in December 2022 for the first-degree murders of his stepfather, Daniel Dale Long, 37, his mother, Risa Mae Saunders, 39, and his brother, Jameson Long, 3. He was found guilty of second-degree murder for the shooting death of his other brother, Gage Ri
