The sentencing of a Minot man convicted in May for the 2024 murder of Mark Ramon McMillan Jr. has been delayed.
Delon Davis, 46, Minot, appeared for his sentencing in North Central District Court on Aug. 1, but surrogate Judge Douglas Mattson ordered for a continuance after Davis’ attorney David Dusek informed the court his client had only received the presentencing investigation (PSI) on July 25. State law requires a defendant to have 14 days to review the PSI before a sentencing can proceed.
Dusek informed the court his client did not want to waive his right to the 14 day review, and Deputy Ward County State’s Attorney Tiffany Sorgen responded saying the state would not dispute the delay.
Davis’ sentencing was rescheduled for Aug. 21. Both parties indicated they did not intend to call
