Out-of-state retailers of alcoholic beverages remain prohibited from shipping their product to Indiana customers, either by common carrier, such as UPS, FedEx and the like, or using their store's own delivery personnel.

A ruling issued this week by the 7th U.S. Circuit Court of Appeals affirmed the constitutionality of Indiana's shipping and delivery restrictions on out-of-state alcohol retailers.

Judges Frank Easterbrook and Michael Scudder Jr. each upheld the validity of the Hoosier statutes, but for different reasons, in their individual opinions.

The panel's third member, Judge Michael Kanne, of Rensselaer, died in 2022 while the appeal was still pending.
