In the last year, Canadians have seen several examples of judges handing down discounted sentences to criminal non-citizens in order to ensure those non-citizens are not automatically deported after conviction.

These sweetheart sentences short-circuit the , which states that non-citizens imprisoned for at least two years lose their right to appeal a deportation order. Instead of following the law as passed by Parliament, judges have twisted themselves into pretzels to avoid handing down two-year sentences.
