The owner of EcoLife Home Improvements in Sudbury and his alleged victims will learn Oct. 9 whether his fraud trial will continue.

Ontario Court Justice Sharon Murphy will rule then on whether David Murray has been denied his right under Canada’s constitution to a speedy trial.

However, regardless of how Justice Murphy decides Murray’s Canadian Charter of Rights and Freedoms application, the Crown and defence will present their closing submissions in the case.

“This is the end of a continuing trial effectively done twice already,” prosecutor Mitchell Flagg told the judge during a virtual hearing on Murray’s constitutional challenge. “The possibility there will not be a (trial) decision with this volume of evidence would be inconceivable.”
