Part of Maryland’s digital ad tax has been ruled unconstitutional.

In a unanimous ruling, a three-judge panel on the 4th Circuit Court of Appeals ruled that businesses collecting the digital ad tax can disclose it on customer bills, and that a state ban on the disclosure violates the First Amendment.

The decision is on one of a series of lawsuits filed against the 2021 tax on digital ads.

In the ruling, the Court noted that disclosing the tax is a form of protest against the tax, something that is as old as the protests against the Colonial era Stamp Act.
