Appeals Court Grants Partial Administrative Stay, Allowing Expedited Proceedings to Continue for Some Immigrants While Case is Reviewed
The U.S. Court of Appeals for the District of Columbia Circuit has issued a temporary administrative stay on a district court order that had placed limits on the government’s ability to conduct expedited removal proceedings.
In a filing dated August 18, 2025, the three-judge panel—consisting of Circuit Judges Henderson, Childs, and Pan—ordered a partial administrative stay of an August 1, 2025, district court order.
The ruling stems from a case, Coalition for Humane Immigrant Rights v. Noem , concerning the application of expedited removal proceedings by the Department of Homeland Security. Kristi Noem is named in her official capacity as Secretary of
