In February, Gallatin County Attorney Audrey Cromwell reinstated one of her prosecutors while her deputy was facing charges of driving under the influence — a decision her office made after deeming the case insignificant.
Dashcam footage and court records show deputy county attorney Jessy Fabbri was taken into custody Feb. 8 by Montana Highway Patrol Trooper Dylan Walls after she moved into the driver’s seat of a sedan during a separate DUI investigation and refused a field sobriety test.
Fabbri was later released on an $885 bond.
Two days later, Cromwell placed Fabbri on administrative leave. But on Feb. 21, after reviewing the footage, Cromwell’s leadership team voted unanimously to bring her back.
"We decided to retain her based on what we viewed in the video," Cromwell said.
