A migrant abuse lawsuit in Buffalo has been abandoned over a problem for the lawyers who sued.
They can't find their clients.
The migrants and whistleblower workers cited filthy conditions at the Cheektowaga hotel where the migrants were taken in 2023 and also accused the National Guard of abusing asylum-seekers. But they have not returned phone calls or replied to letters from the public interest law firm in New York that represents them.
"We haven’t gotten a response from anyone," Arthur Z. Schwartz, principal attorney for Advocates for Justice Chartered Attorneys, told the judge presiding over the case.
U.S. District Judge Lawrence Vilardo dismissed the lawsuit Wednesday without prejudice, which gives it a chance to be refiled.
