The Director of Public Prosecutions (DPP) is deciding whether to prosecute the case against a Nundle man accused of colluding with a NSW Police officer to obtain secret police intelligence.

Jeremy Lee Summers, 42, made a brief appearance at Tamworth Local Court on Monday, September 15, represented by solicitor, Richard O'Halloran, who requested an adjournment as he had recently taken on the case.

No pleas were entered.

The court heard the DPP was considering taking over the prosecution from the police. Police prosecutor Sergeant Brent Robinson told the court that, as the DPP had just received the case file, more time was needed to determine its action.
