A Clinton Township police officer accused of blinding a man in one eye has been denied qualified immunity to shield him against the charge in a pending federal lawsuit.

Daniel Reiff suffered the loss of an eye after he was struck by Officer Broc Setty of the Clinton

Township Police Department after initially running from police.

Reiff’s attorney, Michael Jones of Detroit-based Marko Law, filed a two-count lawsuit against the officer and Clinton Township, alleging the officer violated his constitutional right by using excessive force during the arrest.

Setty claimed he had a qualified immunity, a doctrine used in many case where police are accused of misconduct.

U.S. District Court Judge Laurie J. Michelson ruled the officer didn’t meet the legal threshold to invoke the qualified immun
