TAMPA, Fla. (WFLA) — Florida Attorney General James Uthmeier issued new guidance on the lifting on the state's open carry ban.

Lask week, the First District Court of Appeals ruled that the open carry ban was unconstitutional in the case McDaniels v. State.

Monday, Uthemeier released a guidance memorandum establishing that without any other appellate court considering the ban's constitutionality, the McDaniels decision is "binding on all Florida’s trial courts."

"Meaning that as of last week, open carry is the law of the state," he wrote on social media.

However, certain restrictions on open carry are still in place.
