BUFFALO, N.Y. — State officials on Tuesday sued the Buffalo Sewer Authority for violating permits that allow the agency to dump sewage and other pollutants into the Niagara River and other area waterways.
The lawsuit, filed in State Supreme Court in Erie County, cites a 2014 “control plan” that Buffalo Sewer developed for its Bird Island Wastewater Treatment Facility to meet federal Environmental Protection Agency standards for sewage discharges.
According to the lawsuit – filed by State Attorney General Letitia James on behalf of the State Department of Environmental Conservation – the control plan aimed to reduce discharges “through improvements to BSA’s wastewater treatment plant, creation of additional satellite wastewater storage, and additional conveyance capacity.”
