MACON, Ga. — A Bibb County judge ruled Thursday that the Macon District Attorney's Office can't prosecute a case because they failed to "heed to such basic principles of law" while investigating the case.
Judge Jeffery Monroe ruled on the Macon DA's Office cannot continue prosecuting Harold Housley, who's accused of rape and child molestation.
It comes after two Macon District Attorney's Office staffers — prosecutor Breanna Foster and Nicholas McCane — were present when Housley was questioned at the Bibb County jail without his lawyer.
Monroe ruled that meeting violated Housley's constitutional rights under the Fifth and Sixth amendment. Those amendments give Housley the right to have his lawyer present when questioned by law enforcement or prosecutors.
