A Calgary man has received a reduced prison sentence after being convicted of sexually assaulting a 12-year-old girl. The judge cut two years from the original 10-year sentence, citing the offender's Indigenous heritage as a factor in the decision. The man, identified only as RJM, is of Cree descent and met the victim, referred to as AB, through Instagram when he was 25 years old.
Justice Jayme Williams of the Alberta Court of Justice described the severity of RJM's actions, which included multiple instances of sexual assault and threats against the girl and her family. The assaults occurred between spring and fall of 2023. "The offender repeatedly had sexual intercourse with her knowing that he held the power in the situation not only because of their age difference but also because he had inflicted physical harm on her and psychological terror to ensure that she would comply," Williams stated in his ruling.
RJM's defense attorney argued for a six-year sentence, while the Crown had recommended a full 10 years in prison. Ultimately, the judge sentenced RJM to eight years, acknowledging the Gladue principles, which require judges to consider the unique circumstances of Indigenous offenders. Williams noted that RJM's life has been shaped by significant hardships, including poverty, homelessness, and a history of abuse in the foster care system.
The court heard that RJM had physically assaulted AB, dragging her by the hair and striking her with a metal pole, resulting in visible injuries. He also threatened to kill her and her mother, using graphic language to instill fear. In one instance, he left AB on the side of the road after driving her out of the city.
After learning AB's true age, RJM continued the relationship, demonstrating a conscious decision to engage in sexual acts despite knowing the legal implications. His text messages revealed a disturbing progression from initial shock to a troubling acceptance of the situation.
RJM's criminal behavior escalated, leading to a police chase in September 2023 after he threatened AB and her family. He fled from law enforcement at high speeds, causing significant property damage during his escape. Upon his arrest, police discovered materials in his possession that suggested he had intentions to create explosives.
While in custody, RJM attempted to contact AB multiple times, violating a court order not to communicate with her. He urged a friend to convince her to recant her statement to police, further demonstrating his intent to manipulate the situation.
Justice Williams emphasized the gravity of RJM's offenses, stating, "The gravity of any major sexual assault against a child is high but the gravity of these specific offenses is higher than most." The judge's decision reflects the complexities of balancing justice with the considerations outlined in Gladue principles.
