Sen. Nicole Mitchell testifies during her trial. DETROIT LAKES, Minn. (KVRR/KFGO) — Former Minnesota State Senator Nicole Mitchell’s attorney is requesting that her felony conviction be changed to a misdemeanor at her upcoming sentencing hearing.

Mitchell was convicted of felony burglary and possession of burglary tools by a Becker County jury in July. She broke into her stepmother’s home in Detroit Lakes in April 2024.

Her attorney, Dane Dekrey, is requesting Mitchell’s charges be changed to misdemeanors, and her sentence to be reduced to work release. Minnesota law allows charges to be reduced at sentencing.

Dekrey argues that Mitchell has already been punished for her crimes as she was forced to resign from the legislature and gave up her career in the Wisconsin National Guard.
