MADISON (WKOW) — The ACLU of Wisconsin has filed a petition with the state Supreme Court on behalf of Voces de la Frontera, an immigrant rights group.

The ACLU aims to declare that the practice of Wisconsin jails honoring ICE detainers is illegal.

An ICE detainer requests that local sheriffs hold individuals for 48 hours beyond their state law release time for ICE custody and deportation. The lawsuit argues that this practice constitutes an arrest, which Wisconsin law enforcement cannot perform based solely on ICE's civil administrative warrants.

Tim Muth, senior staff attorney with the ACLU of Wisconsin, said, “We believe that state and local law enforcement are overstepping their authority under Wisconsin law by honoring ICE detainers, regardless of whether they operate under a 287(g)
