A Brooklyn woman who scored a $2.6 million jury verdict after tripping outside a White Castle saw that win thrown out on appeal this week as judges ordered a new trial and slashed the damages as excessive.

The case stems from a 2015 fall, when plaintiff Paula Rendon tripped on a defect in the sidewalk outside a White Castle in Brooklyn. She sued both the burger chain, which rented the property, and Leonardo Asaro LLC, the landlord. After a jury found both negligent, Rendon was awarded $600,000 for past pain and suffering, $1.8 million for future pain and suffering and another $240,000 for medical expenses. The Appellate Division, Second Department, reversed that judgment, saying the trial court made errors that tainted the jury’s verdict.
