CLARKSBURG, W.Va. —Harrison Circuit Judge Joseph F. Shaffer Jr. sentenced the woman guilty of hitting a DOH worker while driving drunk to two to 10 years of home incarceration.
Kiley Michelle Wagner registered a BAC of .20 after the accident on U.S. 50 in Harrison County last March.
The judge cited a lack of prior criminal history, good behavior while on bail, and genuine remorse in issuing the sentence. Wagner has also started efforts to fund a nonprofit that would develop an app to provide a ride service to those in no condition to drive.
The victim, Jordan Swiger, of New Milton, said he still deals with broken bones in his skull and difficulty walking and hearing.
Swiger wanted Wagner to serve the sentence in prison.
Swiger has filed a civil suit against Wagner.
