Syracuse, N.Y. — A grand jury voted to indict a teen on a murder charge stemming from a fatal shooting at a Syracuse pool this summer.

Kyari Cunningham , 15, is charged with second-degree murder and second-degree criminal possession of a weapon.

He is accused of shooting A’Dhon Thomas , 15, in the abdomen with a 9 mm handgun on around 2 p.m. June 24 near the Upper Onondaga Park Pool, according to the indictment.

Thomas was pronounced dead at Upstate University Hospital.

The shooting happened just outside the pool fence as families swam. Lifeguards on duty rushed to aid Thomas as people fled the park.

The teen was on probation at the time of the shooting. Prosecutors could not share why Cunningham was serving probation because he was adjudicated as a youthful offender and
