Albany. N.Y. (NEWS10) -- Opening statements were made this morning in the case against -- year-old Austin Breyette. Breyette is accused of hitting UAlbany student, Alexa Kropf, while illegally operating a dirt bike on a public road. That incident caused life threatening injuries to Kropf. Prosecutors say the bike had no headlights, turn signals, or speedometer.

"He's dressed in all black, he's wearing sunglasses, he's going over the speed limit on a bike he has no business driving on the street" said the prosecution. "No headlights, no brake lights, no turn signals, and he's on dirt track tires that have bad traction. And he is going to violently crash into the body of Alexa Kroft in the middle of that street. She didn't even see it coming."
