A leading cannabis trade group in Michigan has sued the state over a newly minted wholesale tax on marijuana , sparking a legal fight over a key funding component in Gov. Gretchen Whitmer and legislative leaders' plan to pay for local road repairs.

In the lawsuit, filed Tuesday, Oct. 7 in the state's Court of Claims, the Michigan Cannabis Industry Association alleges lawmakers did not have the votes required to enact a new 24% tax on the wholesale price of marijuana. The lawsuit argues the new tax falls under the state's marijuana law, the Michigan Regulation and Taxation of Marihuana Act (MRTMA), which was enacted after voters legalized recreational weed sales in 2018.
