CHARLOTTESVILLE, Va. — ICE officers apprehended a 36-year-old illegal alien from Mexico convicted of sex crimes against a child in Charlottesville Sept. 25. Officers with ICE Washington D.C.’s Harrisonburg suboffice arrested David Ambrosio-Herrera, a Mexican criminal alien convicted of indecent liberties with a child under 15, after he exposed himself to a child at a school bus stop. Amrosio-Herrera has illegally entered the country 3 times, which is a felony, and has a long list of criminal activity in the United States.

“David Ambrosio Herrera is a serial criminal illegal alien and a convicted child sex offender. He is exactly the kind of person we aim to remove from the United States,” said ICE Washington, D.C. Enforcement and Removal Operations acting Field Office Director Joseph Simon. “He has illegally reentered the country multiple times, has prior criminal convictions and should have never been here to traumatize this child. ICE Washington D.C. will continue to prioritize public safety by arresting and removing criminal alien threats from our Washington D.C. and Virginia neighborhoods.”

U.S. Border Patrol arrested Ambrosio-Herrera April 2, 2007, after he illegally entered the United States. He voluntarily returned to Mexico following this encounter. He attempted to illegally reenter the United States three days later but was again apprehended by Border Patrol officials and voluntarily returned.

Ambrosio-Herrera illegally reentered the United States on an unknown date, at an unknown location and without being inspected, admitted or paroled by a U.S. immigration official.

Charlottesville police arrested Ambrosio-Herrera July 7, 2014, and charged him with identity theft: possessing a fictitious ID card. The court convicted him of this charge Aug. 19, 2014, and sentenced him to 30 days confinement.

On Jan. 31, 2017, police in Albemarle County arrested Ambrosio-Herrera and charged him with five counts of perjury: falsely subscribing a written declaration. ICE Harrisonburg entered Ambrosio-Herrera into removal proceedings following his arrest.

On May 15, 2024, a Department of Justice immigration judge ordered Ambrosio-Herrera removed from the United States to Mexico. Officers with the Albemarle County Police Department arrested Ambrosio-Herrera Oct. 25, 2024, and charged him with indecent liberties with a child under fifteen years old. He was convicted at the Albemarle County Circuit Court Sept. 25, 2025, and sentenced to six years in prison followed by two years of supervised probation. He was also ordered to register with the state sex offender registry. The court then suspended all six years of Ambrosio-Herrera’s prison sentence.

Officers with ICE Harrisonburg arrested Ambrosio-Herrera in downtown Charlottesville Sept. 25, 2025, after he exited the courthouse. Ambrosio-Herrera attempted to flee, but ICE officers arrested him after a brief foot pursuit. Ambrosio-Herrera will remain in ICE custody pending his removal from the United States.
