NELSON, Neb. (KSNB) - Prosecutors say evidence from a murder victim’s cell phone does not justify a new trial for a Superior man.
On June 30, a Nuckolls County jury convicted 32-year-old Sebastian Dunbar of murder for the December 2023 shooting death of Molly Gruber.
Court documents show that the next day, prosecutors told Dunbar’s attorney that they had obtained new information from Gruber’s cell phone. Investigators had Gruber’s phone since her murder in 2023, but court documents show they had been unable to crack the phone until June 30, the day Dunbar was convicted.
Dunbar’s attorney asked for a new trial, claiming that the cell phone contains evidence related to drug use by Gruber, as well as new evidence about Gruber’s mental state at the time of the murder.
