A record fine has been handed to an NDIS provider that failed to supervise a participant living with an intellectual disability who wandered away onto a nearby highway and was fatally struck by a car in 2023.

The now-defunct Aurora Community Care Pty Ltd has been ordered to pay a $2.2 million pecuniary penalty by the Federal Court following the Queensland man's death, in the highest civil sanction imposed on an NDIS provider to date.

The court found that Aurora failed to provide supports and services in a safe and competent manner and that there were 131 contraventions of the National Disability Insurance Scheme Act 2013.

Ankur Gupta, 38, was struck and killed by a car on a motorway after wandering from his supported independent living residence in Eagleby, south of Brisbane, in 2023.
