A Toms River, New Jersey, woman says she suffered a traumatic brain injury after being struck in the head by the closing tailgate of a Volvo SUV, a feature she claims was accidentally triggered by a dog.
Megan Kohr filed a lawsuit in Ocean County Superior Court on Oct. 10, alleging that the vehicle’s motion-activated liftgate sensor caused the tailgate to shut while she was standing behind it.
The incident occurred after a hike with Volvo Car USA employee who was driving an SUV owned by the company, the lawsuit said.
Kohr was standing at the rear of the SUV with the tailgate open.
According to the lawsuit, the Volvo employee’s dog walked under the vehicle, triggering the sensor and causing the tailgate to close unexpectedly.
