TUCSON, Ariz. (KVOA) - A new ruling from Pima County Superior Court has set the stage for Christopher Scholtes' upcoming trial, where he faces charges of first-degree murder and child abuse.

The court partially granted the State’s motion to admit evidence of past acts to establish intent, knowledge and absence of mistake. However, it excluded statements about Scholtes' alcohol consumption, citing potential prejudice.

The court emphasized the importance of using limiting instructions to mitigate any prejudice from the admitted evidence. Testimonies regarding Scholtes leaving children unattended in vehicles were deemed admissible, while testimony about his activities on a PlayStation was precluded.
