MOBILE, Ala. ( WALA ) - A judge is weighing whether to grant bail to a capital murder defendant who is accused of gunning down a man at the Saenger Theatre in June.

Mobile man charged with murder after Saenger Theatre dance recital shooting that left 1 dead, another injured

Mobile County Circuit Judge Jay York heard arguments on the issue this morning in the case of Marcus Sanders , who is charged in the death of Carl Williams. It was the second time in less than a month that the judge has considered the issue.

The judge told the lawyers on Sept. 29 that he wanted to see video of the shooting. Today, he asked the prosecution and defense for their interpretations of that video.

York didn’t immediately rule. It’s unusual for a capital murder defendant to get bond.
