Eighth Circuit Signals Future of Police Misconduct Cases May Hinge on the Detail of Resistance by a Protester

In Locke v. County of Hubbard, the U.S. Court of Appeals for the Eighth Circuit, in an opinion authored by circuit court Judge Jonathan Kobes, reversed the dismissal of a protester’s lawsuit against the county and two of its police officers related to excessive use of force in violation of 42 U.S.C.
