Judge Stacy Krueger of the Coconino County Superior Court ruled on Friday, Oct. 10 , that there was sufficient probable cause for the criminal indictment against Max Berkman, one of the defendants from the multi-agency online sex sting operation revealed by the Flagstaff Police Department this spring.
Berkman, 27, is accused of attempting to purchase sex from an undercover detective posing as a minor. Krueger previously granted a motion by Berkman’s defense attorney, Ryan Stevens, seeking a redetermination of probable cause based on allegations that the original presentation of evidence to a grand jury was unfair.
