Lawyers for Kelsey Fitzsimmons say a judge applied the wrong legal standard when reviewing her appeal of an order jailing her, according to a memo they filed Thursday night with the state’s highest court.

Fitzsimmons, 28, a North Andover police officer, is charged with a single count of assault with a dangerous weapon in connection with an incident on June 30, where she is accused of pointing a gun at a fellow officer who shot and wounded her . Officers were at Fitzsimmons’ home that day to serve her with a restraining order obtained by her fiancé .
