CHICAGO — A federal judge who this month ruled that federal agents violated a consent decree governing warrantless immigration arrests said Friday that the agreement now applied to any agents carrying out such operations.
U.S. District Judge Jeffrey Cummings, during a Friday hearing at the Dirksen Federal Courthouse in Chicago, also suggested that he would begin ordering the release of some of the 3,000 people detained this year in Chicago since June.
Cummings ruled this month that Immigration and Customs Enforcement agents violated a 2022 consent decree that prohibited warrantless arrests unless agents have probable cause that the arrestee is in the United States unlawful and is a flight risk.
