COLUMBUS, Ohio - The Cleveland State University-Ideastream deal over WCSB 89.3 could be invalidated because the college did not follow Ohio public meetings law, an expert on public meetings laws said.
David Marburger, a longtime Cleveland lawyer who drafted a revision to the state’s public records act, said that if a government board violates the state’s sunshine laws that require government meetings and decisions be open to the public, the action taken by the board can be invalidated.
Marburger, who represented The Plain Dealer for decades, believes CSU’s Board of Trustees violated the law during an executive session of its Aug. 7 public meeting when the radio station was likely discussed.
