A Newport man will serve prison time for killing his neighbor’s 6-year-old black lab, a Lincoln County Circuit Court Judge ordered Friday.
Tyson Kay, 47, was arrested on July 5, 2024, after his neighbor told police he shot her dog, Daisy. A probable cause document says Kay told police that Daisy had been coming onto his property, eating food and damaging things. He told police he shot her in the back with a less lethal round.
But prosecutors alleged that Kay shot Daisy with birdshot. Daisy’s owners found her “injured, wet and panting heavily,” the Lincoln County District Attorney’s Office said in a news release.
Kay argued at trial that he was trying to protect baby chicks living on his property, according to a news release from the Lincoln County District Attorney’s office. Prosecuto
