The National Company Law Appellate Tribunal (NCLAT) has upheld a Rs 213.14 crore penalty imposed on Meta Platforms by the Competition Commission of India (CCI) while allowing WhatsApp to continue sharing user data with other Meta companies for targeted advertising.
In its ruling on November 4, 2025, a two-member bench of NCLAT, led by Chairperson Justice Ashok Bhushan and Technical Member Arun Baroka, partly set aside the CCI’s decision, removing the prohibition on WhatsApp’s data sharing and the finding of market “leveraging.” However, the tribunal affirmed the financial penalty and retained key directives aimed at ensuring user transparency and the introduction of effective opt-out mechanisms in line with the upcoming Digital Personal Data Protection (DPDP) framework.
