SPOKANE, Wash. — A jury has found Martin Diaz not guilty of assaulting a U.S. Border Patrol agent during an incident earlier this year that was captured on his home security camera.
Court records show Diaz has been released from any detention orders following the verdict. In a message to KREM 2 after the decision, Diaz’s wife, Kendall, said, “Yes, he was found not guilty. We are going to the county jail now to see what happens with ICE.”
Federal prosecutors had accused Diaz of elbowing a border patrol agent in the eye during a struggle at his home, as agents attempted to take him into custody under a deportation order linked to an assault charge from when he was a teenager.
