Bryan Kohberger 's attorneys say their client shouldn't have to pay $27K in restitution ... and, they're set to appear in court in just a few minutes to argue the case.

BK's lawyer Elisa Massoth is in court on behalf of the defense ... though Kohberger himself has been excused from the proceedings.

Prosecutor Bill Thompson says he thought money agreed upon in the plea agreement could be used to reimburse victims in the case ... however, that's not the case, and Thompson admitted he made a mistake.
