The Delaware Supreme Court is expected to issue a decision in a matter of days after three justices heard arguments Monday in a case that will greatly influence New Castle County's collection of property taxes for 2025-26.
The plaintiffs are a coalition of commercial property interests. The defendants are the State of Delaware, New Castle County and several school districts. The issue is House Bill 242 , which was passed during a special session of the Delaware General Assembly that allowed for separate tax rates to be set for residential and non-residential properties, following the first statewide property reassessment in decades.
The Supreme Court normally hears arguments in Dover. Monday, three justices traveled to Wilmington for the quickly-scheduled hearing.
