GREENFIELD, Wis. (CBS 58) -- Greenfield's police chief is now out on a $5,000 signature bond.

Jay Johnson made his first appearance in court Monday, Nov. 10, after being charged with felony misconduct in office .

He's accused of using police equipment as a personal home security system, making threatening calls to the police department and threatening the acting police chief on social media.

But despite a lengthy criminal complaint, Johnson's lawyer argues it doesn't show evidence he committed a crime.

""If you look at the criminal complaint and you set aside, as I said, the opinions and conjecture from witnesses who are interviewed, and you just look at the factual allegations, it misses the mark of probable cause, your honor," defense attorney Jacob Marian said.
