Dear Tony:
I am the president of our strata council and we have an ongoing disagreement about how penalties are imposed when a person does not pay their strata fees or special levies.
We received a response from an owner who has claimed we cannot charge a rate of interest on a recent special levy because we did not include this condition with the resolution that approved the levy.
Our strata corporation policy has always been to charge a 10 per cent interest rate on late strata fee payments and levies, and instructed our property manager to calculate those and compound them each month in arrears, without any complaints. We are questioning our procedures and would appreciate clarification.
