WILMINGTON— The Delaware Supreme Court has unanimously upheld a recent ruling that state lawmakers’ efforts to reset New Castle County School districts’ tax rates were constitutional.

The expedited ruling issued on Wednesday means that House Bill 242 will continue to stand as law, allowing school districts to set separate tax rates for residential and nonresidential properties.

Even though New Castle County now has the approval to move forward with calculations on tax bills, it’s still likely the looming Nov. 30 deadline to pay those bills may be delayed. A new bill is making its way through the Delaware General Assembly that would allow taxpayers to pay their new bills by the end of the year.
