VIRGINIA BEACH, Va. — The trial of a man accused of killing a 15-year-old at the Mount Trashmore Carnival in 2024 was continued until a later, to-be-determined date.

Virginia Beach Police say on May 25th, 2024, 15-year-old Jeyani Upshur and a then-18-year-old Markal Cook were shot near the Mount Trashmore Carnival.

Upshur died in the hospital.

The trial for Cook was set to start on Wednesday, but Judge Tanya Felton said there weren’t enough prospective jury members to start jury selection. Judge Felton credited that to a malfunction in a new software system used by the courts to notify jurors.

“Certainly, they’re still in the process of working out all the kinks in regard to that we’re hoping that that will be done in the future,” said Mario Lorello, one of Cook's attorneys.
